Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and DEV3 Technologies Pvt. Ltd. ("DEV3", "we", "us"), a company incorporated in India with its registered office at E279, Phase 8A, Industrial Area, Sector 73, Sahibzada Ajit Singh Nagar (Mohali), Punjab 160071, India. They govern your use of our website, the DEV3 digital assets marketplace (the "Marketplace") and any agency services we provide.

By creating an account, purchasing an item, submitting an item for sale or engaging our agency services you confirm that you have read and accept these Terms. If you accept on behalf of an organisation, you confirm that you are authorised to bind it. If you do not agree, do not use the platform.

You must be at least 18 years old and capable of entering a contract under the Indian Contract Act, 1872. You are responsible for keeping your credentials confidential and for all activity under your account.

• Provide accurate, current information and keep it up to date.
• Do not share accounts or create accounts to evade a suspension.
• Notify us immediately at support@dev3.tech if you suspect unauthorised access.
• We may require email verification, multi-factor authentication or identity verification before enabling certain features.

Information on this website describes our engineering services in general terms. Each client engagement is governed by a separate written proposal, master services agreement or statement of work ("SOW"), which prevails over these Terms where they conflict.

Estimates produced by our online scoping calculator are indicative only and do not constitute an offer. A binding quotation is issued only after a scoping call and is valid for the period stated on it. Unless agreed otherwise in the SOW, intellectual property in deliverables transfers to the client on receipt of full payment for the relevant milestone.

Items on the Marketplace are created by independent authors or by DEV3. When you buy an item you purchase a licence to use it under the Licensing Agreement — you do not acquire ownership of the item or its intellectual property.

Prices are displayed and charged in US dollars (USD). Where Goods and Services Tax (GST) applies, it is calculated at checkout at the applicable rate (currently 18% for digital goods) and shown separately on your tax invoice. Payments are processed by Razorpay; DEV3 never stores your full card number, CVV or UPI PIN.

• Refunds may be requested within 14 days of purchase where an item is materially not as described, does not work as documented, or has a security vulnerability the author fails to fix within a reasonable time.
• Refunds are not available for change of mind, lack of required skills, or incompatibility with software not listed in the item’s compatibility notes.
• An approved refund revokes the licence and all download and license-key activations for that purchase.

Authors must complete identity, tax and payout verification before items are published or earnings are paid. By submitting an item you warrant that you own or are licensed to distribute every component, that the item contains no malicious code, and that its description is accurate.

Authors earn the sale price net of the platform commission and payment gateway fees applicable to their author tier. Commission tiers, including the reduced rate for exclusive authors, are shown in the author panel and may change with at least 30 days’ notice. Earnings clear after the 14-day refund window and become eligible for payout once the configured minimum threshold is met.

You must not use the platform to:

• Upload malware, backdoors, obfuscated licence-bypass code or content that infringes third-party rights.
• Solicit or accept payments outside DEV3 checkout for items or support listed on the Marketplace.
• Harass other users, post unlawful content or attempt to manipulate reviews, ratings or sales rankings.
• Probe, scan or test the vulnerability of the platform except through our responsible disclosure programme.
• Scrape the Marketplace or resell items or downloads except as permitted by your licence.

The DEV3 name, logo, website design, platform software and original content are the property of DEV3 Technologies Pvt. Ltd. and are protected by Indian and international intellectual property laws. Authors retain ownership of their items and grant DEV3 a non-exclusive, worldwide licence to host, display, promote and distribute them for the purpose of operating the Marketplace.

If you believe content on the platform infringes your rights, send a notice to legal@dev3.tech with the information required under the Information Technology Act, 2000 and the Copyright Act, 1957. We act on valid notices promptly.

We may suspend or terminate an account, remove an item or withhold pending earnings where we reasonably believe these Terms have been breached, fraud is suspected, or we are required to do so by law. Where practical we will tell you why and give you an opportunity to respond.

You may close your account at any time. Licences you have purchased survive closure; outstanding author earnings that have cleared will be paid out subject to verification and any chargebacks or refunds received.

Marketplace items are provided by authors "as is" except for the warranties stated in the Licensing Agreement. To the maximum extent permitted by law, DEV3 is not liable for indirect, incidental, special or consequential losses, including loss of profits, revenue or data.

Our aggregate liability arising out of these Terms in any twelve-month period is limited to the amounts you paid to DEV3 in that period. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or wilful misconduct.

These Terms are governed by the laws of India. Before starting proceedings, both parties will attempt in good faith to resolve a dispute through the escalation steps published in our Trust Center for at least 30 days.

Unresolved disputes will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in Mohali, Punjab, conducted in English. Subject to that, the courts at Mohali (Sahibzada Ajit Singh Nagar), Punjab have exclusive jurisdiction.

We may update these Terms to reflect changes in law or our services. Material changes are notified by email or in-app at least 15 days before they take effect; continued use after that date means you accept the updated Terms.
